SKYTAG RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK AND PHOTO CONSENT
By signing this document, I acknowledge and accept the terms below in favour of SkyTag, its owners, directors, officers, employees, agents, volunteers, contractors, and affiliated entities (collectively, the "Releasees").
1. RELEASE OF LIABILITY AND ASSUMPTION OF RISK
I understand that participation in activities at SkyTag — including but not limited to trampoline, laser tag, CyberSport, arcade games, and any other facility activities — involves inherent risks of physical injury, property damage, or, in rare cases, death. Risks include but are not limited to slips, falls, collisions with other participants or equipment, sprains, fractures, head and neck injuries, and over-exertion.
I voluntarily assume all such risks, whether known or unknown, foreseen or unforeseen, and accept full responsibility for any injury, loss, or damage suffered by me (or by the minor on whose behalf I am signing) while on the premises or while participating in any SkyTag activity.
2. RELEASE AND WAIVER
To the fullest extent permitted by the laws of the Province of Québec, I hereby release, waive, and discharge the Releasees from any and all claims, demands, actions, causes of action, damages, costs and expenses of any nature whatsoever arising out of or connected with my participation (or that of the minor) in any SkyTag activity, except in cases of gross negligence or intentional fault, as those terms are defined under Québec law.
3. INDEMNIFICATION
I agree to indemnify and hold harmless the Releasees from any claim brought by me, by any minor on whose behalf I am signing, or by any third party in connection with my (or the minor's) participation in any SkyTag activity, except to the extent prohibited by applicable law.
4. RESPONSIBILITY FOR DAMAGE TO PROPERTY AND EQUIPMENT
I agree that I am responsible for any damage that I — or the minor on whose behalf I am signing — cause to SkyTag's property, equipment, machines, games, fixtures, or premises through misuse, excessive or unreasonable force, horseplay, intentional or reckless conduct, or failure to follow posted rules, safety signage, or the instructions of SkyTag staff. This includes, without limitation, pulling on, hanging from, striking, climbing on, overloading, or otherwise tampering with equipment, machines, or fixtures in a manner inconsistent with their intended use. Where I am signing as a parent or legal guardian, I accept responsibility for such damage caused by the minor in my care. I agree to reimburse SkyTag for the reasonable cost of repairing or replacing any property so damaged. This section does not apply to ordinary wear and tear, or to damage resulting from the normal and proper use of equipment or from a defect in the equipment itself.
5. MINOR PARTICIPANTS
If the participant is under 18 years of age, I confirm that I am the parent or legal guardian and that I have full legal authority to sign this waiver on the minor's behalf. I have explained the risks to the minor in a manner appropriate to their age and understanding. I accept these terms on behalf of the minor and agree that this waiver binds the minor, myself, and our respective heirs, executors, and assigns.
6. PHOTO / VIDEO CONSENT
I consent to SkyTag and the Releasees photographing and/or video-recording me (or the minor) during my visit, and to using such images for marketing, social media, advertising, training, or promotional purposes, without compensation. I understand that I may withdraw this consent in writing at any time for future use; revocation does not apply to materials already published or distributed.
7. MARKETING COMMUNICATIONS
By checking the marketing box below, I consent to receive SkyTag's monthly newsletter and occasional promotional emails, including updates about events, special offers, new attractions, and other news. I understand that: my consent is voluntary and is not required to participate in any SkyTag activities; I may withdraw my consent at any time by clicking the "Unsubscribe" link in any email or by contacting SkyTag directly; and my personal information will be used only in accordance with SkyTag's Privacy Policy and applicable privacy laws.
8. GOVERNING LAW
This waiver is governed by the laws of the Province of Québec and the applicable laws of Canada. Any dispute shall be brought exclusively before the courts of the judicial district of Montréal, Québec.
9. ACKNOWLEDGEMENT
I confirm that I have read this entire document, that I understand it fully, and that I am signing it freely and voluntarily. I understand that by signing electronically I am waiving important legal rights, including the right to sue, for myself and, where applicable, for the minor on whose behalf I am signing.
